SMS Privacy Policy
Why is text messaging used? Do I have to participate? Can I change my mind?
Purpose of SMS Communications Our clinic uses SMS (text messaging) for non‑clinical administrative communication, including appointment reminders, scheduling updates, billing notifications, and general operational notices. SMS is not used for therapy, diagnostic information, clinical guidance, or emergency communication.
Information Collected When you opt in to SMS communication, we collect your mobile phone number, the date and time messages are sent or received, and delivery/read‑receipt information when available. We do not collect or store diagnostic details, treatment information, or sensitive mental health content through SMS.
Use of Information Your mobile number is used solely for appointment reminders, scheduling coordination, administrative updates, and secure links directing you to the patient portal. We do not sell, share, or disclose your phone number to third parties for marketing purposes.
SMS Security and Limitations SMS is not a fully secure communication method and may be accessed by unauthorized parties through your carrier or device. To protect your privacy, we do not send protected health information (PHI) via SMS. Clinical communication must occur through secure channels such as the patient portal. You are responsible for maintaining the privacy of messages stored on your device.
MISSISSIPPI‑SPECIFIC COMPLIANCE
Confidentiality of Mental Health Information We comply with Mississippi mental health confidentiality laws, including Miss. Code Ann. §§ 41‑21‑97, 41‑21‑101, and 41‑21‑103. Mental health records cannot be disclosed without your written authorization except in circumstances permitted by law (emergencies, court orders, mandatory reporting). SMS communication is administrative only and does not contain mental health record content.
Electronic Communication & Telehealth Standards Administrative electronic communication is handled in accordance with Mississippi telehealth standards, including Miss. Code Ann. § 83‑9‑353 and guidance from the Mississippi Board of Nursing and Mississippi Board of Medical Licensure. SMS is not considered telehealth and does not replace secure patient‑portal communication.
Mississippi Consent Requirements By opting in to SMS communication, you acknowledge that SMS is not secure for PHI, that Mississippi law prohibits disclosure of mental health treatment details without written authorization, and that you may withdraw SMS consent at any time without affecting your ability to receive care. SMS consent is separate from treatment or telehealth consent.
Third‑Party Messaging Vendors If SMS messages are delivered through a third‑party vendor, that vendor must comply with HIPAA, Mississippi confidentiality statutes, and any applicable Business Associate Agreement (BAA). Vendors may not use or disclose your information except as permitted by Mississippi law and our clinic.
Patient Rights Under Mississippi Law Mississippi patients may request restrictions on administrative communication, request written explanation of electronic communication practices, and file privacy complaints with the Mississippi Department of Mental Health. Department contact information is available upon request.
Mandatory Reporting & Legal Exceptions Mississippi law requires disclosure of certain information in limited circumstances, including threats of harm to self or others, abuse or neglect of minors or vulnerable adults, and court‑ordered disclosures. These disclosures are made through secure channels and never via SMS.
CONSENT, RIGHTS, AND POLICY UPDATES
Your Consent By providing your mobile number, you consent to receive SMS messages from our clinic. You may withdraw consent at any time by replying STOP, contacting our office, or updating your patient‑portal preferences. Opting out does not affect your ability to receive care.
Your Rights You may update or correct your contact information, request information about how your number is used, or withdraw SMS consent at any time.
Policy Changes This policy may be updated to reflect changes in federal or Mississippi law, regulatory guidance, or clinic operations. Updated versions will be posted and made available upon request.
